Fundamental Rights - Bedrock of Indian Democracy

The Part III of the constitution of India gives a detailed description on a charter of rights called the 'Fundamental Rights'.

These Fundamental Rights guarantee civil freedom to all the citizens of India to allow them to live in peace and harmony. These are the basic rights that every Indian citizen has the right to enjoy, irrespective of their caste, creed and religion, place of birth, race, colour or gender. These Fundamental Rights include Right to Equality, Right to Freedom, Right to Freedom of Religion, Cultural and Education Rights, Right against exploitation.

The Fundamental Rights were included in the Constitution because they were considered essential for the development of every individual and to preserve human dignity. They are justiciable i.e. any violation of these rights can be questioned in the court of law (Supreme court and High court) through writs.

Changes in Fundamental Rights require a constitutional amendment. The Constitution originally laid seven rights including the right to property, but the 44th Amendment of 1978 deleted the right to property, though it still is a Constitutional Right, long after the deletion of the right to property. Right to Education was added to the list of Fundamental Rights under section 21A on 2nd April, 2010.

Now the Fundamental Rights are categorised under seven sections apart from the general segment from Articles 12 to 35. The Fundamental Rights have been classified under the following main heads

  1. Right to Equality: It guarantees to all persons (Citizens as well as other) equality before the law and equal protection of law. It prohibits discrimination between citizens on ground only or religion, race, caste, sex, place of birth or any of them. All citizens have equal access to shops, public entertainments and places of public resort, which are maintained wholly or partly by the state. However, special provisions may be made in respect of women, children, socially and educationally backward classes and scheduled castes and tribes. The constitution guarantees equal opportunities relating to public employment to all citizens, but some posts may be reserved for backward classes. It abolishes untouchability and also abolishes the system of conferring titles by the state, except military and academic distinctions.
  2. Right to Freedom: It includes a gamut of rights such as right to speech and expression, right to assemble peacefully or to form association, right to move freely throughout the territory of India, Right to life and Liberty, right to reside and settle in any party of India and so on.
  3. Right to Freedom of Religion: All citizens have been guaranteed Freedom of profess, practice and propagate any religion. Every religious group has been given the Freedom to manage its religious affairs and to own, acquire and administer property for religious or charitable purposes.
  4. Right against Exploitation: The Right seeks to ban traffic in human beings, beggar or any other form of forced labour. Employment of children below 14 years of age in any factory or mine or other risky occupations is also prohibited by law.
  5. Cultural and Educational Rights: This right guarantees to the minorities the right of conserving their language, script and culture, to receive education and administer educational institutions of their choice.
  6. Right to Constitutional Remedies: It guarantees the right to move the Supreme Court for the enforcement of Fundamental Rights. This proclamation of emergency by the President.
Before moving further it is important to note that the Fundamental Rights given in Article 12 - 35 of the Indian Constitution cannot be violated. In case of its violation, it can be questioned in a court of law through certain writs under Article 32. The Writs are as follows:
  • Habeas Corpus: This writ is a command of the court to a person who is detaining other person, to bring the body of the person in his custody at a stipulated time and place for a specified purpose.
  • Mandamus: It is an order that commands a person or a body to do what constitutes his or its duty as legal performance.
  • Prohibition: This writ is issued to prevent a junior court not to exceed its jurisdiction or act contrary to the norms of the natural justice.
  • Certiorari: It is used to order the shifting of a suit from a lower court to higher court to prevent an excess or abuse of jurisdiction before the commencement of the trial.
  • Quo Warranto: It restrains a person from acting in an office to which he is not entitled. The court may declare the office vacant.

There are certain Fundamental Rights which are granted only to citizens of India and not to foreigners. This includes protection from discrimination on Grounds on religion, race, caste, sex or place of birth (Article 15) equality of opportunity in matters of public employment (Article 16) freedom of speech and expression (Article 19) and cultural and educational rights (Article 30)

Ever since its adoption, the chapter on Fundamental Rights in the constitution has been under criticism, both in India and outside. The critics argued that some important right such as right to work etc were not included.

It was also pointed out that the spirit of the whole chapter was killed by taking away much of the freedoms or rights provided through the insertion of many preventive provisions such as preventive detention, suspension of the right to constitutional remedies etc.

The concept of fundamental rights limits the power of government and prevents the executive and the legislature from becoming authoritative or dictatorial and also it provides an opportunity for the individual for self development.

Constitutions that did not contain such provisions, have resulted into dictatorial rule. Hence, the philosophy and concept, underlying the fundamental rights is that constitutional limitation on the power of the government at the only way of ensuring and safeguarding the basic human freedoms and so the dignity and self respect for the individuals.

The success or failure of a democracy depends largely on the extent to which civil liberties and basic rights are enjoyed by the citizens. A democracy must aim at the highest development of the individual, which is certain to be achieved through the fundamental rights.

Only a free society where an individual feels dignified, enjoy basic rights can assure the all round and quick progress of its member and thus of the nation itself. Herein lies the importance of Fundamental Rights in the success of democracy.

Essay - Metro Rail

The rapidly growing population, expanding cities, and heavy rush, as a result of rapid industrialization and urbanization has led to the need for the cheap and convenient modes of conveyance for the public transport, especially in the metro cities. A well planned Mass Rapid Transit System (MRTS) such as the Metro Rail forms the lifeline of the cosmopolitan cities which have a population in thousands of Lakhs.

The government must decide the metro model for a population region depending on the basis of the region's logistics, financial resources, population. It should avoid aping metro models of the other countries. The fact that the metro projects are meant to serve the cities with more than four million population needs to be kept in mind. The costs associated with these projects are decided on the basis of the metro project being underground, elevated or at ground level. Larger the underground and elevated proposal, larger shall be the cost involved. The funding of the metro project is done through the Public Private Partnership (PPP) model. The private sector brings in the required expertise, technical knowledge and the funds.

Metro Rail Projects in India.

At present, India has eight operational metro systems. The Kolkata Metro was the first mass rapid transit system of India which became a reality in 1984. It was the rising transport problem in Kolkata which resulted in the building of the first underground metro in the country. Currently, it has just one functional line and five other lines are under construction. It is the only metro service in the country which is functioning directly under the Indian Railways.

The Delhi Metro has been successful in ushering a new era in the sphere of mass urban transportation in India. The swanky and modern Metro System introduced comfortable, pocket - friendly, air conditioned and eco-friendly services for the first time in India. It has completely revolutionized the mass transportation scenario not only in the National Capital Region (NCR) but the entire country. The network has now crossed the boundaries of Delhi to reach Noida and Ghaziabad in Uttarpradesh, Gurugram and Faridabad in Haryana. The Airport Express Link between the Indira Gandhi International Airport and New Delhi has now brought Delhi to the league of Global cities which have high speed rail connectivity between the city and the airport. The Delhi Metro has also contributed tremendously to the environment, by becoming the first ever railway project in the world to claim the carbon credits by the United Nations.

It has helped to reduce pollution levels in the city by 6.3 Lakh tons every year, thus contributing significantly to reducing the global warming. The Delhi Metro uses regenerative brakes in the trains which lead to reduced carbon emissions. The Delhi Metro Rail Co-operation (DMRC) has partnered with Google India to provide train schedule and route information to Mobile devices with Google maps. It has also set up roof top solar power plants at many of its stations. All stations of the presently under construction are being constructed as green buildings. The Rapid Metro Rail Gurugram is an underground rapid transit system in Gurugram which is linked with the Delhi Metro.

The Chennai Metro Rail project is a joint venture between the Government of India and the Government of Tamil Nadu. The project aims at providing the people of Chennai a fast, reliable, convenient, efficient, modern and economical mode of public transport, which is properly integrated with other forms of public and private transport including buses and sub-urban trains. It is the first elevated railway line in India.

The Mumbai's Metro is Asia's first Green Metro and carries lakhs of the population every day. Bengaluru Metro also known as Namma Metro is the transit rail system in the Bengaluru city. It has both elevated and underground metro stations which enhance the connectivity of its capital of the country. The Jaipur Metro has a double storey elevated road and metro track which has been used for the first time in the country. Besides, a number of metro systems are being planned for Agra, Bhopal, Chandigarh, Dehradun, Gwalior, Hyderabad, Indore, Kochi, Lucknow, Ahmedabad and Pune to name a few.

Most of the metro projects in the country are built under the public private partnership (PPP) model. This because the private sector can bring in the required expertise, technical knowledge and funds required for the successful building and execution of these projects.

Benefits of Metro Projects.

The Metro Rails which are used as a mass transit are environmental friendly than the other public transport facilities, private vehicles emit about twice as much harmful to the environment. The Metro has been successful in reducing the number of cars on the road which in turn reduces the pollution caused by Individual cars. Besides, it has helped in reducing the congestion and traffic problems in different metro cities significantly. The Metro has led to the commercial and economic development of the country by generating a number of jobs. Besides, the metro stations and corridors offer a business opportunity for different players. A large number of metro stations provide the site for advertisements. The Metro stations offers a large number of food joints, shopping outlets and other such recreational spots. Most of the business houses prefer setting up their offices near to the metro. This increases the connectivity and reduces the effective travel time for their employees; indirectly leading to improved productivity. The capacity of metro rail is much more than the other public transport.

This help in saving the resources such as fuel and energy which are spent on the transportation of the public from one end to the other. Metro has high speed, halts at specific stations and thus saves the time to a large extent. Besides it is pocket friendly and doesn't compromise on the comfort factor. All members of the society irrespective of their financial status, religion or caste are able to travel which enhances the social integrity of the country. It is a blessing for those individuals who are unable to drive.

The availability of the limited infrastructure for the public transport calls for the government to invest in the metro rail projects. The government needs to provide incentives and special benefits to attract the private sector players and the multi nationals to invest in our country. Besides, the attention should be on promoting the use of sustainable and renewable sources of energy in the construction of these projects. A rapid and efficient metro system in India will significantly contribute to the overall economic development of the country.

[Essay] Where there's a will, there's a way

The proverb means that we need a strong will and determined effort to overcome the seemingly insuperable obstacles in our way. It says that people with superior will and resolute determinations succeed where those with feeble will and wavering mind fail and falter.

History is full of examples of people of average intelligence and physical strength reaching great heights of power, prestige and popularity. Demosthenes , the Athenian , who finally became one of the greatest orators of all time was a weak voiced boy and a stammerer. But he was so determined to become a great orator that he overcome these physical handicaps with single-minded devotion, determination, dedications and, above all, with an iron will. This enabled him to realize his dream and fulfill his ambition of becoming a first rate orator of his time, nay of all time.

The history of India's struggle for freedom is full of striking examples of how people with strong iron will accomplished seemingly impossible tasks. Mahatma Gandhi, Jawaharlal Nehru and other great leaders aroused the sleeping masses of India to fight against the formidable power of British rulers and finally wrested freedom from their unwilling hands. They provided motive force behind their splendid achievements.

And see, what man has achieved in the modern time! At one time it was thought impossible to fly in the air, to orbit the earth, to travel in space, to send speech over the air to transmit photos to distant places. But today we find that such imppossible dreams have come true. The aeroplane, the spaceship, the radio and the TV are realities already.

Great souls have will, feeble ones have only wishes

This Chinese proverb aptly sums up the truth of this proverb Let us cultivate a strong will, a keen mental desire and determination to achieve our ideals. Let us remember the well-known verse

Standing at the foot, boys, gazing at the sky; How can you get up, boys, If you never try?

[Essay] If i were a scientist

India has given to the world a great many scientists like Sir Jagdish Chandra Bose, Sir Vishweshwaraiya , SrinivasRamanujan, Sir C. V. Raman, Dr. Homi Bhabha, Dr. Vikram Sarabhai and Dr. Abdul Kalam. I admire them all.

So many a times I keep wondering what “If I were a scientist” let me think. What can I do for the best of my Country, my people and all of the above for all the living beings residing on earth. How can I be useful to humanity? How can I be useful for the conservation and preservation of earth? To what extent I would be at service to mother earth?

If I were a scientist, service to mankind would be first and foremost duty of life. I would work round the clock to invent remedies for deadly diseases like AIDS and cancer. I would try to put an end to human suffering . I would invent medicines that would make and old age worth living.

As a scientist, I would request all the scientists of the world to use the atomic and nuclear energy for the welfare of mankind only. Moreover I would pray to God to remove deadly diseases of human mind like greed, jealousy, enmity etc. thus I would do my level best to be a true servant of mankind if I were a scientist.

[Essay] Modern Advertising

Advertising is the means used by business establishments to attract favorable attention to their products, property and services for sale or for rent. Advertising may also be used to promote ideas or projects. In itself, advertising is an important industry.

Most advertising agencies employ trained men or women to work for them. These are people trained in subjects such as business management, economics, copy writing and so on. They decide not only how much money to spend but also where to spend it. They study features of their product or service or project and decide which will appeal to the public most. They also devise strategies to make the public aware of these features. Sales persons employed by business concern go from door to door making their product known to the masses.

Communication media such as the radio, television, video, cable networks, Internet especially on social networking sites such as face book, Google+ and many others are also extensively used. The services of writers, illustrators, photographers, models, typographers, layout artists, actors, singers and announcers are used in a big way to create and display advertisements.

Most advertisements are intended to sell specific products or services. However, advertising is also widely used for non - commercial purposes. Political parties, government agencies and social service organizations frequently resort to advertisement.

Besides creating a desire to buy, advertising can also be an aid to the customer by helping him to find out whether the products or services he intends to buy are of a good value and whether they meet his desires. Advertising helps to win public confidence. It also creates goodwill and public awareness.

Newspaper and magazines carry a lot of advertisements. Printed matter sent through the mail is also utilized. While choosing the medium of advertisement and how to advertise the advertiser considers which section of people in a society is likely to buy the product or service. He will consider factors such as age, habits, tastes. He will also consider the comparative costs. A local newspaper will not charge much for advertising. But a national magazine or the network television will charge exorbitant rates.

The oldest form of advertising is probably the street cry - the shout of a merchant or hawker calling out his wares on a street. In many places street vendors still follow this method, often with each hawker having a distinct cry.

When shops began appearing symbols were used to advertise products. For example, a shop selling dairy products might have a cow or buffalo painted on the signboard above. It is only with the arrival of the paper that advertising expanded in its utility and scope. Today Internet communications disseminate advertising information to nations all over the world.

What you people think about the advertisements? Morality included in it or not?

[Essay] have newspaper become obsolete ?

Newspapers play a vital role in our life. we cannot imagine a single day without newspaper in the morning. It has become a part and parcel of our routine with news from far and near. It gives us, at a glance what is happening all over the world. It brings us abreast of latest information, discoveries and inventions, the toppling of a government, the forming of a new government, the winning and losing of a match, an earthquake, a plane crash, accidents, the lives of great people, tragedies, comedies and so on which can be read any time conveniently during the day or later.
with the development of science and technology, many inventions such as DTH, internet, satellite television, through which we can watch any event happening anywhere in the world, it does appear that the newspaper has become obsolete. There is nothing worthwhile in it which we cannot watch on T.V. Indeed what is recorded by the camera is more authentic and objective than the second hand report of an individual which is bound to be more subjective.
No two newspaper accounts of an event will be the same. One newspaper will report a fifteen year old girl killed while another will report a fifty year old girl killed while another will report a fifty – year old woman. Every newspaper in its struggle to strive in a haste to report something first no matter, regarding its authenticity, leaving the poor average common reader confused by the different news in different newspaper.
Television, on the other hand, gives you a watch and believe eye witness account of the entire happenings so that you can judge and reach to any conclusion according to your discretion. Most of the space in newspapers is consumed for drab advertisements but on T.V. advertisements which not only inform but entertain as well are shown.
But, now the question remains. can we say good-bye to our newspaperman? do we really have to start the day by pressing the T.V. switch? Would we rather put a glance at the headlines in the newspaper and look forward to reading the entire newspaper later in the day? There are so many new items in it which  are not carried by T.V. and no replacement for the classified ads column yet. Moreover, there are some very interesting articles which can be read out any time, where as to gain importance from the T.V. we are dependent on the times of T.V. program. So according to me as long as human beings can read, newspapers cannot become obsolete
What you people think about newspaper? Comment your views..

[Essay] Are we happier than our forefathers

Today’s generation enjoys the fruits of science and technology. they have a better standard of living because of increase in per capita income. Today there are two incomes in the family – mother’s and are we happy father’s. There is more education, more material comfort like TV, internet, i-pods, mobile phones and speedy means of transportation. However, when we compare our lives with the childhood and youth of our grand fathers we find that on the whole they had better lives than ours. They had time on their hands and lived a less hectic pace.

Modern youth is a victim of time and fame. The idea of material acquisition has led conflicts in society. It has led to alienation of the family and loneliness in life. People  are ready to sacrifice health and happiness in order to pursue material happiness.

Our forefather’s had time for picnics, to be with nature. They gave importance to practical education, spent time with nature built strong bonds in society, had time for the family.

Life was not mechanical for them. Many ladies did not study much but they were not superstitious or backward. they led peaceful lives happily with their pots, pans and children. They managed the house within their means and civilization still progressed. The modern men and women live on the edge. They are not able to cope with problems. Though they have received education, it does not make them better human beings. They are not able to adjust themselves with changing times. They have no quality time to spend with their children and families.

Family values are dwindling and depression and shallowness have crept into people. There was never the fear of evils like terrorism which has crept into our lives. We wish we could bring back our forefather’s  peace and security in the present times.

Discipline means following rules and regulations and obeying people with authority and experience. Discipline and freedom are contradictory. Discipline is required in all walks of life and in day to day life – office, homes, on the road, armed forces, social and political lifeself-discipline

Discipline  means conferring to certain  unwritten  laws of society so that the wheels of the society are kept moving without a hitch.

It does not mean encroaching on an individual’s freedom but it is the the delicate equilibrium between freedom and doing what’s good for others and for oneself. It has made man evolve from the savage stage to the modern evolved species.

[Essay] Generation Gap

Generation gap means a difference of opinion between youngsters and elders.  It includes difference in tastes, attitudes, thinking manners and behavior of the members of the two generations.generation gap

In olden times children obediently followed what their parents told them to do. Today’s youth are more exposed and influenced by modern technology and life style. They are more independent, assertive and open. They don’t want anybody interfering with their lives or imposing their views on them.

On the other hand the elders have lived their lives and are set in their ideas and views. They too hate to be dedicated too or tossed around. The result is total disagreements among the two generations leading to intolerance, quarrels or even breaking up of the family.

This problem exists everywhere in the world and it has given rise to children staying away from their parents. In certain cases the problem gets out of hand and children are shown the door in the house or children go and deposit their old parents and grand parents in old age homes.

What is required is mutual respect and tolerance. Both youngsters and elders must respect each other’s individuality and not interfere with their way of living.

Youngsters should understand that parents are well wishers so they should show them respect and patience and imbibe what is good from them.

Elders should also give space to youngsters and change a bit with time. If there is mutual admiration and tolerance the generation gap issue would not exist.

The trend of making resolutions is as old as the burning of the effigy of the old man. The tradition laid stress on forgetting the old and ushering in the new year with new beginning and aspirations.

Resolutions are made at the beginning of the year in order to lay down goals, which are desirable and achievable. Every year before new New Year’s Day one needs to contemplate on what one has done during the year. [essay]Use and abuse of leisure

Leisure means free time away from routine work, which can be spent doing activities of hobbies, which one likes to do like i_leisurereading, hearing music, collecting stamps, gardening. Some misunderstand the meaning of leisure. For them it means whiling away time, roaming and wandering aimlessly, playing pranks etc. Leisure is a must to give a break to a dull routine. It is wrong to use holidays as working days.

People who don’t believe in leisure, suffer from boredom, tension or depression. Leisure doesn’t mean indulging in heavy activities and it also doesn't mean wastage of time.

Those who while away time are abusing leisure. They get into a lethargic mode and find it difficult to get out of it. Those who inculcate hobbies can wisely use their time and ensure their all round development.

By playing sports and doing physical activities we can be physically fit. Leisure activities should not be expensive and time consuming . They should not in any way hamper the peace and harmony of social life.

Leisure gives us the time to introspect and know ourselves. we can meditate and do yoga. Through introspection we will be able to know ourselves better and work towards our personal and spiritual growth. A person who doesn’t enjoy leisure amply supports the maxim – “All work and no play makes Jack a dull boy!”

[Essay] Should School bag be made lighter?

Every child going to school is physically harassed with the burden heavy school bag of carrying many books per subject. Their school bags run into kilos, weighing down their tiny backs and stunting their physical growth or giving them back and spine problems.

A committee headed by Prof. Yashpal brought out a report in 1933 A.D. stating the need for check on the curriculum load for school going children.

In their 12 point recommendation the committee stated that the pressure on students is worst when too much is taught just before the examinations.

There are too many textbooks, densely packed. The matter is written in convoluted language and teachers just skim through it to cover up the course on time.

Children fail to comprehend so they usually memorized and reproduce like parrots during the examination. This is not an enjoyable experience.

Subjects like mathematics, Social studies, Science, languages are taught in hurried manner so children are hardly able to follow them to develop a liking for them.

Usually when topics like grammar are taught, the tests are taken immediately but later the child has no recall value so he cuts a sorry figure where languages are concerned. Most of the students pass without understanding the subjects. All they have learnt is cramming. This problem can only be solved if study topics are backed with activities to be performed by the pupils and teachers as a group activity.

Topics need to be logically discussed in class by honing the students skills of curiosity and clear understanding. It is time we redefine our approach to education and its aim. Textbooks with errors should be immediately pulled out of circulation and students should not be made into confused bundles who don’t know what to do – score well by cramming wrong things or have the guts to write the wrong things at the cost of marks in the examinations.

The students bags need to be made lighter but their brains need to be made more fertile and developed.
